Searches Done After an Arrest

  • Police can search you, and the area around you, if you are arrested.
    • This includes the area around you if you are at home, but not the whole house.
    • If you weren’t in the house when you were arrested, police cannot go in to search the house without a warrant.
    • Police can search the interior of your car if you are arrested as part of a traffic stop – but it might not include the trunk. It depends on the particular situation.
