Bail: Get Me Out of Here!

  • Bail is a promise, made with money, to appear for future court dates.
  • If you appear at all your court dates, you get your bail money back – even if you are convicted.
    • If you pay cash to bail out, you get all your cash back.
    • If you get a bail bond from a bondsman, you pay 10% of the bail but you don’t get any of it back.
  • A judge will consider several things when deciding to set bail, including:
    • Your criminal history and ties to the community.
    • Whether you are a risk to yourself, the community, or at risk of not coming to future court dates.
      • If the court thinks you won’t show up for future court dates, you are considered a “flight risk.”
    • The seriousness of the charge. Some serious offenses are not eligible for bail at all.
  • If you not a flight risk or other risk, you might be released, or have your bail lowered to make it more affordable for you to pay bail and go home.
