Penalties for Underage Driving Under the Influence (DUI) In Tennessee

  • If you are convicted of DUI while you are under 21, there you will HAVE to go to jail for at least 48 hours, but you could ALSO get a sentence of up to 11 months and 29 days in jail.
    • Have you smelled the inside of a jail?
  • If the blood alcohol content is .20 or higher, you would HAVE to spend 7 days in jail.
    • This is considered a DANGEROUSLY HIGH blood alcohol content – to the drinker and everyone else on the road around him.
  • There is a fine to pay for DUI: at least $350, but not more than $1500. You’ll also owe more for court costs. They’re expensive – court costs can be higher than the fine!
  • There will be other costs: you will probably need an attorney, insurance will be much more expensive, you might have to pay for towing and impound if they took your car, you may have to pay for a DUI school … so a DUI can cost you in the neighborhood of $5000 or more.
  • With a DUI on your record, you will not be able to work as a driver for a LONG TIME – not for many, many years.
  • Last but not least: YOU WILL LOSE YOUR DRIVER’S LICENSE FOR A YEAR. Period.

Can It Get Worse Than That?

  • The impact on your driver’s license is terrible if any of the following situations apply with your episode of underage drinking:
    • With a minor in the car, OR
    • With a BAC of .15+, OR
    • If you refuse to take a chemical test after arrest, OR
    • If you have a wreck ….
  • * Notice the “OR” … only one of those situations has to be present for the 5-year loss of license problem to come up.
  • * Five years of asking for rides, riding your bike, taking the bus, taking Uber… WALKING
