Not Married: Having Sex With Someone Under 18 (even if it’s love)

  • An 18 year-old having sex with someone 13 or younger, … or just touching the person (even outside their clothing) for sexual gratification…
    • … Is a felony: the court can impose a fine of up to $50,000, at least 15 (and up to 60) years in prison, or both.
  • An 18 year-old having sex with someone over 13 and under 18:
    • If the older person is more than four years older, or if the minor is 15 and the older person is more than five years older (but less than 10 years older)
      • This is also a felony: there is a fine of up to $3,000, at least 1 (and up to 6) years in prison, or both.
  • If the minor is at least 13 and the adult is ten or more years older:
    • It’s a felony: there is a fine of up to $5,000, at least 2 (and up to 12) years in prison, or both.
