Understanding Your Rights: Lesson 5

Even More “At Will” Employment Rights

  • You can take a reasonable amount of time from work (up to three hours) to vote in elections.
  • If more than 100 people work for the employer, new moms and dads can take up to four months off work when a new baby (or adopted child) arrives in the family.
    • This doesn’t guarantee you’ll be paid unless you have paid leave time saved up, it just means that you’ll have a job to come back to.
  • Under the federal Family Medical Leave Act (FMLA), you can’t get fired if you have to take time off (up to 12 weeks) for a major medical reason for yourself or a family member, or to take care of things related to a family member’s military service, if the company is big enough, and if you have been there for a while.
